The role of the Legal Investigator often requires that an interview of a witness be had and then a report summary of same is provided to the criminal defense attorney, insurance defense attorney, or personal injury attorney; which ever the case may be. We assist in preparing counsel for trials and help during the examination of evidence, discovery, and also have assembled evidence and reports for the attorney both prior to and during trials as well as post trial during sentencing hearings and in preparation for 35 b hearings. The role of the Legal Investigator is critical!

In fact, those who have allegedly committed crimes who are awaiting judgment, are often over charged by law enforcement and the District Attorneyfs Office. The clientfs life and liberties are at stake. More often than not, a competent Criminal Defense Investigator does not have former law enforcement experience. Although it is not necessary, sometimes it is also desired by the clientfs attorney. Sometimes someone with a law enforcement background ought to be consulted and it can actually be crucial advisement for the Criminal Defense team in a particular case. The point is, all options should be considered for the client. A competent Investigator is one who can be objective and insightful and is one who pursues the ultimate truth. Each client is unique, each case matter is different, and often times, more often than not, a case review requires several eyes to give more than one perspective when developing the theory of defense.

We do not carry guns, which is not say that we do not know how to use firearms, but we do not run around with guns nor do we have concealed weapons permits. We will not put ourselves out as law enforcement officers just to get in front of a witness to get the interview. We follow local, State & Federal laws with respect to our authority and role as Private Investigators and Private Process Servers (no real authority at all actually). We are tactful and professional and highly ethical. Our tasks require finesse, tact, and real people skills. We don't use brute force nor will we ever physically pin someone down for questioning. We do not bust in doors when chasing bail skips or other skips for that matter. We are not affiliated with law enforcement in any way. Our assignments are not and should not require an interrogation of any subject or witness of investigation. Interviewing people, serving process; It's about the art of selling oneself at the door, getting in the door tactfully, gaining rapport, and winning favor and talking casually with the person about what was seen at the scene. This is how we should always conduct ourselves as professional Legal Investigators.
Talking to people; encouraging them to talk, listening to them, and getting them to talk more. What do they know? That is what this is about. And since an Attorney can not be his or her own witness, why not use a competent legal investigator to conduct and record the interview? With respect to criminal defense investigations, ALL interviews shall be audio recorded either digitally or with an audio tape device (unless the witness does not consent to the recording). The audio recording will reflect this consent, along with the date/time of interview, and it will be clarified on the audio recording that the Investigator is a PRIVATE INVESTIGATOR and NOT affiliated or associated with any law enforcement agency in any way and it will be clarified that we are working with [name of attorney] who represents [name of defendant/Plaintiff] and then the conversation (interview) shall be continued (conducted) under same recording. A summarized transcription can also be made available for attorney client privileged work product.

LOCATING MISSING WITNESSES & DEFENDANTS

YES! We can find people. We do it literally every day. We are a full service investigation firm. Something important to know; we are not skip tracers. We are private investigators. When the infinite WEB goes down, our investigation continues...
Skip Tracers have the luxury of accessing hundreds of databases while at their 9-5 desk job. They can pretend to be somebody they are not while on the telephone, legally using cover names (if they are debt collectors in Colorado), and are able to use all kinds of clever and tricky little pretexts to get people on the phone. Getting a debtor or witness or subject of foreclosure to come to the door in person is a whole other story and art in and of itself.
We practice the Lost Arts of the Traditional Gumshoe. What this means to you is that we, more often than not, end up having to locate a witness off a three year old piece of discovery which reflects the subject's address on the police report or accident report and in some cases, reflecting the subject's address as "homeless"! Well, our investigation begins from ground zero with nothing to really work with. The people we often find are not the types of people who are registered to vote, who are corporate officers, or those who run down to the local DMV to apply for a change of address when they move, and most likely don't apply at the post office for a forwarding address. Generally, a competent skip tracer is able to find these types of people while searching on the web and accessing the many different available free databases and search engines like "Google" as is found on the free internet sites. Most likely, the people we end up having to find have a last known address which is that of a local homeless shelter. Sure, we definitely have access to information and databases which can provide us with utility records, phone records, unlisted and non-published phone numbers, but more often than not, we end up having to do good ole fashioned street canvassing, people and neighbor interviewing, and dumpster diving.
